Agreement between User and EEEAdvisor, Inc., doing business as (“DBA”) DrBalcony
Welcome to https://drbalcony.com/. The https://drbalcony.com/ website (the “Site”) and the proprietary software platform, including any associated browser extensions we may make available (“Extension(s)”), web interfaces, RSS feeds, newsletter, HTML widgets, and the EEEAdvisor or DrBalcony Android and iOS mobile applications (“Application(s)” and, collectively, the “Services”) offered by EEEAdvisor, Inc. dba DrBalcony (“EEEAdvisor”, “DrBalcony”, “our”, “we”, “us”). The Services are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of the Services constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy for your reference.

The purpose of the Services is to serve as a digital platform for our business, DrBalcony, to showcase our services and manage customer interactions. Specifically, our company provides building inspections for compliance with California’s SB 721 and SB 326, which are focused on ensuring the safety and structural integrity of balconies. The Services serve as a resource for potential and existing clients to learn about these regulations, the services we offer, and how they can schedule inspections or access reports through tools. Additionally, our website helps promote our business and serves as a point of contact for customer support, inquiries, and online payments.
Electronic Communications
Visiting the Services or sending emails to DrBalcony constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email, through the Applications, and on the Site, satisfy any legal requirement that such communications be in writing.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and/or device, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that DrBalcony is not responsible for third party access to your account that results from theft or misappropriation of your account. DrBalcony and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
Children Under Thirteen
DrBalcony does not knowingly collect, either online or offline, personal information from persons under the age of thirteen, or sixteen where applicable. If you are under eighteen, you may use the Services only with the permission of a parent or guardian.

The Services may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of DrBalcony and DrBalcony is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any change or updates to a Linked Site. DrBalcony is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by DrBalcony of the site or any association with its operators.
Certain services made available via the Services are delivered by third party sites and organizations. By using any product, service or functionality originating from the Services and/or https://drbalcony.com/ domain, you hereby acknowledge and consent that DrBalcony may share such information and data with any third party with whom DrBalcony has a contractual relationship to provide the requested product, service or functionality on behalf of the Services’ users and customers.
No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these terms and of use. As a condition of your use of the Services, you warrant to DrBalcony that you will not use the Services for any purpose that is unlawful or prohibited by these Terms. You may not use the Services in any manner which could damage, disable, overburden, or impair the Services or interfere with any other party’s use and enjoyment of the Services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Service.
All content included as part of the Services, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Services, is the property of DrBalcony or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Services. DrBalcony content is not for resale. Your use of the Services does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of DrBalcony and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of DrBalcony or our licensors except as expressly authorized by these Terms.
Third Party Accounts
You will be able to connect your DrBalcony account to third party accounts. By connecting your DrBalcony account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.
International Users
The Service is controlled, operated and administered by DrBalcony from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the DrBalcony Content accessed through the Services in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification
You agree to indemnify, defend and hold harmless DrBalcony, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. DrBalcony reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with DrBalcony in asserting any available defenses.
Arbitration
In the even of the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or similar arbitration services selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and DrBalcony agree otherwise, the arbitrator may not consolidate more than one person’s claim, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. EEEADVISOR, INC. AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SERVICES AT ANY TIME.
EEEADVISOR, INC. AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EEEADVISOR, INC. Termination/Access Restriction
DrBalcony reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any person thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Services. Use of the Services is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and DrBalcony as a result of this agreement or use of the Services. DrBalcony’s performance of this agreement is in derogation of DrBalcony’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by DrBalcony with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and DrBalcony with respect to the Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and DrBalcony with respect to the Services. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
DrBalcony reserves the right, in its sole discretion, to change the Terms under which the Services are offered. The most current version of the Terms will supersede all previous versions. DrBalcony encourages you to periodically review the Terms to stay informed of our updates.

- Application marketplaces, for example Google Play or Apple App Store.
- Government regulators
- Our legal advisors and parties whom we are compelled by court order to disclose your Personal Information to.

Video Viewing Behavior
As described elsewhere in this privacy policy and for purposes of clarity, your video viewing activity, including information as to whether you requested or obtained specific video materials or services, may be collected and shared by DrBalcony with third parties, including, without limitation, service providers with whom we partner to provide our Services to you, as well as our advertising, social media and other business partners. By using our Services where videos are displayed, you consent to the collection and sharing with third parties of your video viewing activity, if any, with each such consent being valid for two years from the date of such use or until you withdraw your consent by emailing privacy@drbalcony.com .
THIRD PARTY LINKS
Our Services may contain links to other websites, applications or services that are not owned or controlled by us, including links to Social Media Platforms, or may redirect you off our Services to other locations for information or other services. This Privacy Policy only applies to information collected by our Services. We are not responsible for the privacy and security practices of other websites, applications or social media platforms or the information they may collect (which may include IP address or device identifiers). You should refer to such third parties’ privacy policies on their sites to determine their respective privacy practices. Links to any other websites, applications, Social Media Platform or content do not constitute or imply an endorsement or recommendation by us of the linked website, application, Social Media Platform, and/or content.
THE DRBALCONY EXTENSION
Information the Extension May Access
For every webpage you view while using the Extension, the Extension may have access to your IP address, the full general information about your browser, and general information about your computer or device's operating system. We use this information solely to enable functionality of the Extension.
Information About Visited URLs
The Extension will have access to all webpages you open through the browser where the Extension is installed. Furthermore, any data you enter into the address bar, along with your IP address, is transmitted to DrBalcony and third parties which data DrBalcony uses for the Extension, such as Google, Alexa, Bing and others (the list of such third party services is contained in the “Parameters” section of the DrBalcony toolbar settings). You agree that such data you enter into the address bar may contain personally identifiable or other sensitive information at your own risk. We do not assume or accept responsibility as to how the indicated third parties store or handle such data. Please be aware of this fact and familiarize yourself with the privacy policies of such third parties before you start using the Extension.
Automated Statistics
We may collect anonymized automated statistics of the use of the Extension on a specific computer or device. These statistics includes such data as the URLs visited, the frequency of use of each extension parameter, and other user activities within the Extension. We use the third party service, Google Analytics, to collect the statistics. We do not control how they handle the data being processed, so please familiarize yourself with Google’s Privacy Policy at https://www.google.com/intl/en/policies/privacy/ before you start using the Extension. You can disable collection of the statistics in the “Settings” section of the toolbar. In such case, no above-mentioned statistical data from your computer will be obtained by us.

ACCESSING, CORRECTING, OR DELETING YOUR PERSONAL INFORMATION

Transfers

PRIVACY POLICY FOR CALIFORNIA RESIDENTS
Under the California Consumer Privacy Act, California Civil Code Section 1798.100, if you are a resident of California you may contact us with regard to the following rights in relation to your personal data:
- Right of Access: You have a right to request access to the personal data we may hold on you for the past twelve (12) months. You may submit up to two (2) requests per year of access to your personal data.
- Right to Opt-In/Opt-Out of Sale of Personal Data: For individuals sixteen (16) years or older, you have the right to opt-out of sale of personal data we may hold on you. You can exercise this right at any time by emailing us at: privacy@drbalcony.com. For individuals between thirteen (13) to sixteen (16) years old, you have the right to opt-in to the sale of personal data we may hold on you.
- Right to Deletion: You also have the right to ask us to delete personal data we may hold on you or restrict how it is used. There may be exceptions to the right to deletion which, if applicable, we will set out for you in response to your request.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your California Consumer Privacy Act rights.
If you want to make any of these requests, please contact privacy@drbalcony.com. We will deal with requests for access to your personal data within forty-five (45) days for California-specific requests.
To help us respond as you expect, please specify that you are making a request under the California Consumer Privacy Act. We may need to request specific information from you to help us confirm your identity. If you provide us with proof of identity containing information that does not match our records, we may request further proof of identity from you.
RIGHTS TO YOUR PERSONAL DATA
This Section is included in this Privacy Policy to comply with the requirements of the General Data Protection Regulation (“GDPR”). It applies to all individuals visiting or using our Services.

- Right to file a complaint with the supervisory authority: If you have a concern about our privacy practices, including the way we handled your Personal Data, you can report it to the supervisory authority that is authorized to hear those concerns in your jurisdiction, although we invite you to Contact Us with any concern as we would be happy to try and resolve it directly.

The requests above will be considered and responded to in the time period stated by applicable law. Certain information may be exempt from such requests. We may require additional information from you to confirm your identity in responding to such requests.
Legitimate Interests
“Legitimate interests” means the interests of our company in conducting and managing our organization. For example, and without limitation, we have a legitimate interest in processing your Personal Data to analyze how the Services are being used, to administer our contractual relationships, fulfil legal obligations, process employee data, prevent fraud or criminal activity or misuse of our products or services, ensure the security of our IT systems, architecture and networks, and meet our corporate and social responsibility objectives, and/or effectively and efficiently operate our business and provide you with the services offered through our Services, as described in this Privacy Policy. Data Transfers
DrBalcony is based in the United States, and we use service providers (described above) based in the United States to operate our business and our relationship with you. When you use our Services, you acknowledge that your Personal Data may be transmitted, stored, processed by us and our service providers’ servers in the United States to provide you with the services that you requested, administer our contract with you or to respond to your requests as described in this Privacy Policy. The United States may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. Where we transfer your Personal Data out of the United States we will take steps to ensure that your rights continue to be protected. We endeavor to apply suitable safeguards to protect the privacy and security of your Personal Data and to use it only consistent with your relationship with us and the practices described in this Privacy Policy. We also enter into data processing agreements and model clauses with vendors as appropriate.
Data Retention
We will keep your Personal Data only for as long as is reasonably necessary for the purposes outlined in this Privacy Policy based on the context in which you provided it, or for the duration required by law, whichever is longer.
CHILDREN’S ON-LINE PRIVACY INFORMATION
In general, the Services are not intended for use by children under the age of 13, or 16 where applicable, and the terms for certain Services may specify further age-related restrictions. In cases where certain Services are intended for use by children under the age of 13 (or 16 where applicable), we will post appropriate notices and take steps as required by applicable law to safeguard children’s data. In addition, we do not knowingly collect Personal Information from children under the age of 13 (or 16 where applicable) through form submissions on our Services, although certain third party sites that we link to may do so. These third-party sites have their own terms of use and privacy policies and we encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide information on our Services without their permission.
Involvement of parents: In accordance with the provisions of the Children’s Online Privacy Act, in the event that we do begin collecting any Personal Information or data from children under the age of 13 (or 16 where applicable), we will notify parents first, and will seek parental or guardian consent to collect, use and/or disclose certain Personal Information from children under the age of 13, or 16 where applicable. A parent may review and have deleted their child’s Personal Information, and may refuse to permit further collection or use of their child’s information by contacting us as noted at the end of this Privacy Policy. Parents may consent to our collection and use of their child’s Personal Information without consenting to the disclosure of that information to others.
If you have reason to believe that a child under the age of 13 (or 16) has provided Personal Information "Contact Us" below with sufficient detail to enable us to delete that information from our databases.

We may amend this Privacy Policy at our discretion and at any time. In the event of any conflict between any such third-party terms and conditions and this Privacy Policy (as it relates to Personal Information or Personal Data), this Privacy Policy will govern.
This Agreement will be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
This Agreement is personal to you and you may not assign it to anyone. We may assign this Agreement and all rights and obligations hereunder at any time. If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this agreement and will not affect the validity and enforceability of any remaining provisions. This Agreement is not intended to benefit any third party, and does not create any third party beneficiaries. Accordingly, this Agreement may only be invoked or enforced by you or us.
You agree that regardless of any statute or law to the contrary, any claim or cause of action that you may have arising out of or related to use of the Services or this Agreement must be filed by you within one year after such claim or cause of action arose or be forever barred.
